1. Key Policies

Refund Policy

Due to the digital nature of Gym Content Co and the immediate access members receive to digital templates, captions, content ideas, resources, and other membership materials, all sales are final and non-refundable.

We do not offer refunds for:

• Failure to cancel before a renewal date
• Forgotten or unintended renewals
• Claims of not using the membership
• Failure to download or customize available content
• Unused time remaining in a billing period

In select circumstances and at our sole discretion, Gym Content Co may choose to issue a refund or account credit. Doing so in one instance does not create an obligation to provide a refund in any future circumstance.

Cancellation Policy

You may cancel your membership at any time through your account dashboard.

Cancellation takes effect at the end of your current paid billing period. You will continue to have access to Gym Content Co until the end of that billing period.

It is your responsibility to cancel your membership before your next renewal date if you do not wish to be charged again.

Cancellation does not entitle you to a refund for previously processed payments or unused membership time.

Monthly Subscription Terms

Monthly memberships are billed monthly and automatically renew each month unless canceled.

There is no long-term commitment associated with the monthly membership.

You may cancel at any time through your account dashboard. Cancellation will take effect at the end of your current billing period and no additional monthly charges will be made after cancellation becomes effective.

Annual Subscription Terms

Annual memberships are billed once per year and automatically renew annually unless canceled before the renewal date.

By purchasing an annual membership, you acknowledge and agree to automatic annual renewal.

It is your responsibility to manage your subscription and cancel before the renewal date if you do not wish to continue.

Annual membership payments and annual renewal payments are non-refundable once processed, except where required by applicable law.

Payment Failures

If a membership payment fails, Gym Content Co reserves the right to retry the payment using the payment method associated with your account or another payment method you have authorized and placed on file.

If payment cannot be successfully processed, access to Gym Content Co may be paused or terminated until your billing information is updated.

2. Membership Use

Each Gym Content Co membership is intended for one gym or fitness business and its associated social media account(s) unless your membership plan expressly states otherwise.

Your membership may be used to create and customize content for the business associated with your account.

Membership access, templates, captions, content calendars, trending reels, content ideas, marketing resources, training materials, or other membership materials may not be shared with unrelated businesses or unauthorized third parties.

If you operate or manage content for multiple unrelated gyms or businesses, a separate membership or applicable multi-business license may be required for each business.

Social media managers, agencies, freelancers, and marketing professionals may not use one Gym Content Co membership to provide Gym Content Co content to multiple clients.

Sharing login credentials or membership content in a manner that circumvents these Terms may result in suspension or termination of the account without refund.

3. What Your Membership Includes

Depending on your membership and the features currently available, Gym Content Co may provide access to resources including:

• Ready-to-customize social media templates
• Ready-to-use captions
• Monthly content calendars
• Weekly trending reels and instructions
• Content ideas and prompts
• B-roll and filming ideas
• Marketing resources
• Educational resources and trainings
• Instagram Analytics
• AI-assisted content tools
• Additional digital resources and features

New content may be added periodically or monthly as described on the Site.

Gym Content Co reserves the right to add, modify, replace, or discontinue individual features, resources, templates, tools, or content as the membership evolves.

4. Content Ownership + License

All original content available through Gym Content Co, including but not limited to templates, designs, graphics, captions, copy, content calendars, content ideas, marketing resources, videos, training materials, website content, branding, and other digital materials, is owned by Gym Content Co or its licensors and is protected by applicable intellectual property laws.

Purchasing a membership does not transfer ownership of Gym Content Co materials to you.

During an active paid membership, you receive a limited, non-exclusive, non-transferable license to access, customize, and use eligible Gym Content Co materials for the permitted gym or fitness business associated with your membership.

You may customize templates with your own:

• Branding
• Logo
• Business information
• Photos and videos
• Offers
• Pricing
• Messaging
• Colors and fonts
• Other business-specific information

5. Prohibited Content Use

Gym Content Co content may not be:

• Resold
• Redistributed
• Shared with unauthorized third parties
• Sublicensed
• Uploaded to another membership, content library, template library, course, resource vault, or digital product
• Sold as templates or digital resources
• Republished or distributed as your own original templates or resources
• Bulk downloaded, scraped, copied, or archived for unauthorized purposes
• Used to create or operate a competing content membership, template membership, content vault, resource library, or substantially similar digital product

You may not purchase a Gym Content Co membership for the purpose of copying, reproducing, studying, collecting, or repurposing Gym Content Co materials for another commercial content product or membership.

Gym Content Co reserves the right to monitor account activity and restrict, suspend, or terminate accounts where activity reasonably appears to violate these Terms or constitute misuse of the membership.

Violation of these provisions may result in immediate termination without refund and may result in further legal action where appropriate.

6. Use of Downloaded Content After Cancellation

Templates and other eligible materials that were legitimately downloaded and customized for your permitted business during an active, paid membership may continue to be used by that business after cancellation.

Cancellation does not grant the right to:

• Continue accessing the membership platform
• Download additional membership content
• Share previously downloaded materials with other businesses
• Resell or redistribute content
• Use the materials to create competing products or services

Your license remains subject to these Terms even after your membership ends.

7. Account Responsibilities

You are responsible for maintaining the confidentiality of your account login information and for activity occurring through your account.

You agree to provide accurate account and billing information and update that information when necessary.

You may not provide account access to unauthorized individuals or allow another unrelated business to use your membership.

Gym Content Co reserves the right to suspend or terminate an account if we reasonably believe it is being shared, misused, or used in violation of these Terms.

8. Instagram Analytics + Connected Accounts

Gym Content Co may allow members to connect an Instagram account to view analytics, insights, or other account information within the membership platform.

By choosing to connect your Instagram account, you authorize Gym Content Co and applicable service providers to access and process information made available through the permissions you approve.

The availability and accuracy of Instagram data may depend on third-party platforms and integrations.

Gym Content Co does not guarantee that Instagram Analytics will always be available, uninterrupted, complete, or error-free.

Instagram, Meta, or other third-party platforms may change their APIs, permissions, functionality, policies, or access requirements at any time. These changes may affect the availability or functionality of Gym Content Co features.

9. AI-Assisted Features

Gym Content Co may offer AI-assisted tools for generating captions, content ideas, marketing copy, or other materials.

AI-generated output should be reviewed before use.

Gym Content Co does not guarantee that AI-generated content will be completely accurate, unique, error-free, or appropriate for every business or situation.

You are responsible for reviewing, editing, and approving generated content before publishing it.

10. Social Media + Business Results

Gym Content Co provides content, templates, ideas, resources, and tools designed to make social media marketing easier for gym owners and fitness professionals.

However, Gym Content Co does not guarantee any specific marketing or business result.

We do not guarantee:

• Increased followers
• Increased engagement
• Increased reach
• Leads or inquiries
• New members
• Membership sales
• Increased revenue
• Viral content
• Specific social media performance

Results vary based on many factors outside of our control, including how content is customized and used, your audience, location, pricing, offers, competition, posting consistency, business operations, and changes to social media platforms or algorithms.

11. Responsibility for Published Content

Gym Content Co provides customizable marketing materials and resources.

You are responsible for reviewing and customizing materials before publishing them.

You are also responsible for ensuring that any information you publish, including pricing, promotions, fitness information, health claims, testimonials, before-and-after content, music, images, offers, or other materials, complies with applicable laws, regulations, advertising requirements, platform policies, and your own business policies.

Gym Content Co does not provide individualized legal, financial, medical, health, or fitness advice.

12. Media Usage Rights

Gym Content Co may provide access to photos, videos, graphics, or other media assets as part of the membership.

These materials may include:

• Licensed stock content
• Content available through third-party design or media platforms
• AI-generated visuals
• Original photos, videos, graphics, or other media created for Gym Content Co

Members may use eligible media as permitted within Gym Content Co materials for marketing and promotional purposes related to their permitted gym or fitness business.

Media assets may not be independently resold, redistributed, sublicensed, or claimed as original works created by the member.

Certain third-party assets may also be subject to the license terms of their original provider.

13. Prohibited Activities

When using Gym Content Co, you agree not to:

• Interfere with the operation or security of the Site
• Attempt to gain unauthorized access to another account
• Share your account with unauthorized users
• Resell or redistribute Gym Content Co materials
• Scrape or systematically extract membership content
• Circumvent access restrictions or membership limitations
• Copy Gym Content Co materials for a competing service or product
• Use the Site for fraudulent or unlawful purposes
• Misrepresent your affiliation with Gym Content Co

14. Third-Party Services

Gym Content Co may use or integrate with third-party services, including payment processors, social media platforms, analytics providers, hosting providers, design platforms, email providers, or other technology services.

Your use of certain third-party services may also be subject to their respective terms and privacy policies.

Gym Content Co is not responsible for interruptions, outages, policy changes, errors, or discontinued functionality caused by third-party services outside of our control.

15. Acceptance of Terms

By accessing the Site, creating an account, purchasing a membership, or using Gym Content Co, you agree to these Terms & Conditions and our Privacy Policy.

If you do not agree to these Terms, you should not purchase or use Gym Content Co.

16. Eligibility

Gym Content Co is intended for users who are at least 18 years old and legally capable of entering into a binding agreement.

By creating an account or purchasing a membership, you represent that you meet these requirements.

17. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect.

18. Dispute Resolution

Before initiating a formal dispute, you agree to contact Gym Content Co at support@gymcontent.co and make a reasonable effort to resolve the matter directly.

Any dispute arising from or relating to these Terms, the Site, or your Gym Content Co membership will be resolved through binding arbitration in Pinellas County, Florida.

By agreeing to these Terms, you waive your right to a jury trial or to participate in a class action, to the extent permitted by applicable law.

19. Termination

Gym Content Co reserves the right to restrict, suspend, or terminate membership access if we reasonably determine that a member has:

• Violated these Terms
• Misused membership content
• Shared unauthorized access
• Infringed intellectual property rights
• Engaged in fraudulent activity
• Used the platform or content in an unauthorized manner

Termination due to violation of these Terms does not entitle the member to a refund.

20. Changes to These Terms

Gym Content Co may update these Terms from time to time to reflect changes to the membership, platform, business practices, technology, or applicable requirements.

Updated Terms will be posted on this page with a revised “Last Updated” date.

Continued use of Gym Content Co after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
